REPORT AND RECOMMENDATION
"After considering the arguments of both parties, we recommend that the District Court GRANT the motion to dismiss, based on the fact that the defendants were not properly served. However, we also recommend that the District Court find that, should proper service be effected in the future, this Court does have personal jurisdiction over the defendants, and they are subject to the CROA."
All right! I hope they didn't just settle, but will refile. It's about time! This was a class action for failing to REFUND fees to dissatisfied customers.
