Transcript of the 9/5/02 first contact by Joseph Udall, attorney for Capital One. He left this message on Holly's VM Thursday afternoon. She didn't hear it until Friday. "Hello, Holly. My name is Joe Udall. I am an attorney who has been retained by Capital One Bank to respond to the Justice Court Complaint that you filed for $2,500. I am going to be filing an Answer on Monday as well as a counter claim for the full $600 and change, plus my attorneys fees which will likely to be significantly more than the $600 on Monday. I want to reiterate the offer to settle this thing, that LeighAnne Coverstone gave to your credit counselor of we will correct your credit to an R-5 to an R-9, ah... I'm sorry, switch that around, that's an R-9 to an R-5, you will pay the $200 and you agree to dismiss the lawsuit and we will just kind of walk away. If not, Capital One has authorized me to file an Answer, fight the lawsuit and file the counter-claim. Pleae give me a call as to what you'd like to do. My phone number is 480-222-0398. Again, that is Joseph Udall. U-D-A-L-L, 480-222-0398. I look forward to talking to you. Hopefully we can talk today or Friday. Otherwise we will prepare the documents on Monday for the Answer and Counterclaim." We decided that we better immediately pay in full to avoid those attorney fees and I called him and informed him that Holly already sent $200 and a check for the remaining balance was going out that weekend. Udall filed the counterclaim on 9/11, KNOWING that the payments had been mailed. To listen to this VM excerpt you need to *right click* on the file and SAVE it as .mp3 file on your drive.
