8/24/04 -- Order to dismiss Trans Union
Trans Union was dismissed because I served them late. However, they had accepted service and ANSWERED the complaint. Several months later, they filed the motion to dismiss. As I recall, Trans Union didn't have any citations in support of the dismissal, nor does Judge Broomfield explain his decision.
If the appeals court allows this dismissal to stand, many of my claims will be time barred. And, Trans Union could have waited until after the trial and THEN submitted the motion to dismiss - is this bizarre or what? I believe that they should have filed the motion to dismiss instead of answering and their motion was untimely.
Trans Union deliberately waited to file the motion to dismiss so I couldn't quickly file before my 2 years were up.
