As per the NHHEAF letter, this loan defaulted in 1989, was paid in full in 1996, and they will continue to report until 2003.

In response to the small claims suit, NH Higher Ed filed for dismissal and a motion for sanctions of $500 for harassment.

It's pretty obvious from their letter and their response to the suit that NHHEAF reages ALL paid loans, not just Holly's.

Since we can't find an AZ lawyer to take this case on contingency, and our best lead is to pay $150 for a review of the case, AND Holly is facing a filing deadline -- well, we'll just do what we can.

"Because this filing was without merit and intended merely to harass Defendant, Defendant also requests the Court award appropriate sanctions including costs and attorneys fees of $500."

"3. Defendant is not a debt collector under the Fair Debt Collation Practices Act."

We all agree with that! Holly never claimed that NHHEAF is a debt collector.

Re. TFC - eventually we found out that TFC was a FAKE account that never existed and had nothing to do with NHHEAF, who failed to inform us.
