Unscrupulous mortgage companies like First Magnus purchase leads from junk faxers and spammers who solicit unsophisticated borrowers with totally false advertising.
First Magnus claimed that it is not liable for the junk faxes as it "only" purchased leads. Of course their loan agent Justin ADMITTED that he got the leads from faxes and the advertisement clearly violates TILA.
If the payments to the leadgenerators aren't violating the RESPA prohibition of ILLEGAL KICKBACKS, what is?

I had to APPEAL the Kingman Justice Court dismissal of this case and after the case was remanded by the Superior Court, we settled. Just on time too, as First Magnus went out of business a few months later.
